Privacy statement

We thank you for your interest in our website with the URL https://bildungsverein.de (hereinafter referred to as "website"). Below we have listed detailed information for you regarding the handling of your data concerning the use of our website.

Liability

Storage of access data

At every access to our website access data is stored in a log file on the web server of our provider.

This data set contains

  • the IP-address of the inquiring device,
  • date and time of the request,
  • the name and the URL of the requested file,
  • the transferred data volume,
  • the report whether the request was successful,
  • identification data of the used browser and operating system,
  • the website from which the access was made, as well as
  • the name of your internet-access-provider.

The collection of data is necessary due to technical reasons. The data does not allow any conclusions on your person using our website without without providing your IP-address is unfortunately not possible due to technical reasons.

We store the access data, subject to legal confrontation, for up to 7 days, to ensure the operational safety of the website as well as detect and prevent cyber-attacks.

Cookies

We store cookies on the storage medium of your device, in order to make our offer more user-friendly, more effective and safer. This is in our business as well as economic interest to minimize costs caused by misuse.

These are exclusively cookies that are necessary for the technical function of the website. These are deleted at the end of the session. We do not use any other cookies, especially those that would allow third parties to track your activities on our website.

Cookies are small text files which are sent by the web server of your provider to the browser of your device and are then stored on it. The cookies are needed to identify you after successful log-in to your user account for the whole duration of your visit, so that you do not have to enter your user ID and password on every site. Furthermore, cookies ensure that you can "bookmark" several courses to be booked in your shopping cart and sign up for all of them at once.

Cookies for the logon to your user account are deleted automatically as soon as you have logged off through the button "Logout". Make sure to always log of before leaving the website, especially when others use your browser (workplace, internet café etc.). Cookies for the shopping cart are deleted automatically after signing up.

The Bildungsverein uses Cookies exclusively for their own purposes. We do not use Cookies that would allow third parties to track your activities on our website.

Usually, the browser of your device is set so it accepts the creation and storage of cookies. You have the possibility to set your browser so that it will object to the storage and use of cookies in general or for an individual case. In this case, the functionality of our website could be limited. 

Links to Facebook, Twitter, Instagram and YouTube

The Bildungsverein does not use any plugins of social networks. Every time you see logos of Facebook, Twitter, Instagram or YouTube on our website, you can keep surfing without worrying: These are passive links to the mentioned services, which will only pass on information to these services after clicking on them.

Up to this point, no information on the sites you have visited will be passed on to the mentioned services by our website.

Please note that this changes as soon as you click on one of the logos, for example to publish a course recommendation on Facebook. At this moment, Facebook (obviously) receives information about which course you are recommending and can connect this with your profile that you have on Facebook, should you be logged in on Facebook with your browser. The same is valid for the providers of Twitter, Instagram and YouTube.

Course registration

Through the link "Kurs buchen" and the button "Buchen" below the respective course description, you have the possibility to register for the courses of our offering. The data regarding a course asked during the registration are used for the execution of pre-contractual measures and contract fulfillment. At this point, a distinction is made between mandatory data (indicated with an asterisk) and optional data. Without the mandatory data (first name, name, address, sex, date of birth and e-mail address) no contract can be made. We collect your date of birth so that we can match registrations later on without doubt to your person. Furthermore, we need your date of birth to ensure that you are of age, or to fulfill legal requirements in case of minority. We use your e-mail address to send you a confirmation of the entrance of your course registration as well as our acceptance of the course registration. When registering for an online course, the email address is also used to send the course code.

We ask for your telephone or mobile phone number in our legitimate interest to be able to contact you directly in case of changes regarding the course. If you do not submit this data, we might not be able to get in touch with you in time. The other optional data are also used for the contract fulfillment. 

By providing the IBAN, BIC and name as well as first name of the account holder, you can grant a SEPA Direct Debit Mandate to us. The optional additional data are also used for the execution of the Direct Debit Mandate. If you do not supply the mandatory bank data, you cannot register via the online form. In this case, please choose a different way to register and execute the payment of the curse fee in another way.

Your e-mail address is also used to send you information on the status of your course bookings and an e-mail reminder three days before your course starts with all important facts about the course (all together called "informational e-mail"). This is in our legitimate interest to make the communication with you easier and cost-saving. These informational e-mails include the title, course number and further information about the course you registered for. 

All data provided by you are stored electronically. The thus resulting databases and applications can be maintained through our contracted IT-service providers. The provision of your data by you is neither legally nor contractually mandated for most of our courses. For certain courses we may be obligated to pass the data on to a government agency, e.g. in case of an integration course to the BAMF. You can find further information under "Weitergabe Ihrer Daten". Non-provision of optional data does not have any further consequences, apart from us not being able to contact you in time about changes regarding the course. 

User account

If you agree, we will use your e-mail address to create an user account for you on our website with the URL www.bildungsverein.de. In this case, we will send you an invitation e-mail after receiving your course registration and successful registration with the user name and access password for your user account (hereinafter called "login data") as well as an activation link, on which you will have to klick in order to activate your user account. In this invitation e-mail we will inform you especially about the processing of your data in connection with the activation and usage of your user account. 

You can log in with the given login data after activating anytime on our website and access all current data and dates for the activities you registered for as well as - in case of language courses - participate in course-related discussion forums.

Doing so, our web system stores the following personal data about your person: first name and name, the e-mail address you provided, your user name in the web system, the access password you chose as well as the IP number of the device you used during the visit at the Bildungsverein (computer, tablet, smartphone).

I you take part in a language course which offers course-related forums, a list of forums which you can access is stored additionally to your user account. Furthermore, all posts you create in forums will be connected with your user ID. However, the user ID is designed so that third parties cannot conclude your full name from it.

Please make sure to log off from your user account before leaving our website. This you can do though clicking on the button "Logout" on our website. This serves to protect your data from unauthorized access of third parties. 

You can have your user account deleted anytime. Please inform us of this in written form. 

Newsletter

You can give us your approval to use your e-mail address for sending you our newsletter during the course registration as well as via the link "Newsletter". Without your approval, we will not use your e-mail address for this purpose. You can revoke your approval at any time with effect for the future. You can inform us about the revocation via mail, e-mail, fax or by pressing the link in the newsletter.

By signing up for our newsletter, you have made the following declaration:

"I agree to be informed by the Bildungsverein about news and offers via mail on a regular basis (approx. 6 times per year). I can revoke this approval at any time with effect for the future."

If you open the newsletter and click on the link in it, this is recorded by our web server (date, time, e-mail address). This serves internal statistical purposes. These data are not merged to personal usage profiles. 

Contact form

When using our contact form, accessible via the link https://bildungsverein.de/kontakt, your e-mail address is necessary so that we can reply to your matter. This serves - depending on your status as interested party or participant - to execute pre-contractual measure or contract fulfillment. 

Further processing for legal defense or prosecution

We can use your data for our own prosecution or legal defense in our legitimate interest.

Transfer of your data

We will only transfer your data to third parties if we are authorized or obligated to this by law. This same is valid if we get your data from third parties.

There also is an authorization if a third party process your data on our behalf: If we do not perform our business operations (e.g. operation of the website, payment processing) ourselves, but have other companies perform them and these operations are connected to the processing of your data, we will have bounded these companies by contact to only use the data for the legally permitted purposes. We are authorized to control these companies in this respect. 

We give your names to the respective course instructor for preparation and conduct of the course. For the participation in certified testings and examinations (e.g. Goethe- or Test DaF language testings, IHK certificates, Xpert), we will pass the for this necessary data (name, first name, date of birth and location of birth, for Goethe testings additionally nationality and mother tongue) on to the testing institute. These submissions serve the contract fulfillment. For the participation in integration course we have to submit your name and necessary contact data to the Bundesamt für Migration und Flüchtlinge (short "BAMF"). Furthermore, submissions to government agencies may be required for courses which are financed though land resources and such that are funded by the Agentur für Arbeit. These submissions are based on a legal obligation. 

If you are delayed with a payment, we reserve the right to submit your data (name, address, year of birth) to a collection service provider for the enforcement of the claim in our legitimate interest.

Storage duration and deletion of data

After the contract execution, your data will be deleted, unless there are statutory storage obligations. In this case, your data will be stored up to 10 years. Your data will be locked for any other use, apart from - if applicable - permitted postal advertising. Disclosed bank data will be deleted after revocation of the direct debit authorization or or in case of long-term direct debit mandates 36 months after the last utilization. If you have given your approval for our newsletter, your e-mail address will be stored until revocation.

Should you have given us permission to create a user account for you on our website, but have not activated it by clicking on the according link in our invitation mail, it will be deleted automatically after 30 days. If you have activated your user account, but are not using it continuously, it will be deleted automatically 730 days after the last login.

The data you provided us with when using the contact form will be deleted as soon as the communication is ended or your matter is solved and these data are not at the same time used for contractual matters or the newsletter. 

Data that you have entered for the use of the recommendation feature will not be stored by us. The fact that you have accessed a recommendation feature will only be stored for the normal usage log files of the website and will never be evaluated personalized.

Your posts in course-related forums will automatically be deleted 28 days after the end of the course.

In case we will process your data for prosecution or legal defense due to a legal dispute, your data will be stored for the duration of the lawsuit or until the expiry of the legal limitation period. The limitation period can be up to 30 years, whereas the regular limitation period ends after 3 years.

Data security

Since the beginning of our web presence, we have adopted extensive technical and organizational security measures in order to protect your personal data from loss or abuse. Like this, your data are stored in a secure operating environment in an European computer center, which is not accessible to the public.

Our web server automatically sets up a safely encrypted connection to your web browser. Through an according certificate (as you have seen with banks or other trustworthy websites), you can know from the start that you are really connected to our server. In most browsers a green lock appears in the box of the web address.

The up to date technical privacy of your data is ensured, however abuse or hacker attacks cannot be ruled out with a hundred percent certainty.

The access to your user account is only possible after entering your personal password. You should always treat your access data confidentially and log off when having ended the communication with us, particularly so, when you are sharing your device with others. Closing the browser window or surfing on another website does not replace logging off. 

Please note that no full-on confidentiality and data security can be ensured during the communication via e-mail. We recommend to send confidential information by mail.

 

You rights (information, correction, blocking, deletion, objection, revocation, transfer, complaint)

You can object to the processing of your personal data through us due to reasons which arise from your special situation at all times. For this matter, you can use the above mentioned contact opportunities (responsible people, data protection officers). If you enter an objection, we will not process your personal data any longer, unless we can present compelling legitimate reasons for the processing, which prevail over your interests, rights and freedoms, or the processing is carried out due to legal claims of our part.

You always have the right to receive free-of-charge information on the data we have stored, to correct false data and have data locked or deleted. Furthermore you have the right to receive your data in a structured, conventional and machine-readable format and to have your data transferred through us to someone else. The legality of the data processing, which are based on an approval and that have been made up to the revocation are remain unaffected by this. You can also use the above mentioned contact opportunities (responsible people, data protection officers) in order to enforce these rights.

Apart from the above mentioned rights, you have also the right to complaint to a data protection authority.
